Prearranged Funeral Plans (aka Trust contracts)
Under Manitoba Law
The Public Utility Board of Manitoba currently administrates the Prearranged Funeral Act of Manitoba. This department can be reached at (204) 945-2639
All funeral homes that engage in writing contracts called Prearranged Funeral Plans must follow provincial legislation requiring that certain criteria be met.
These funerals homes must present their contracts for approval, present their retail price lists for acknowledgement, post a surety bond and pay the required licensing fees, and register and deposit their trust funds with a recognized Trust Company or Bank.
"Prearranged Funeral Plan" means an agreement whereby, in consideration of payment therefore in advance, by a lump sum or instalments, a funeral director contracts to provide funeral services for a person alive at the time the agreement is made.

Third Party Agreements
Consumers may purchase "funeral or final expense" insurance to pay for their eventual funeral costs. This form of planning is encouraged by many funeral directors today. When a consumer has purchased an insurance or annuity plan from a licensed agent and or company that purchase of insurance written falls under the scope of the Insurance Act in Manitoba.
Funeral directors may choose to give letters of agreement to the consumer stating: that if the proceeds of the insurance policy is assigned to the funeral home upon the owner's death the funeral home can at their option provide guaranteed agreements to the consumer providing for the delivery of "guaranteed goods and services". The consumer should note that although these forms of insurance are transferable, the guaranteed goods and services agreement provided by the funeral director will be subject to the receiving funeral director's acceptance of the same.
